'Claims for Restitution against Third Parties under the Principles of Contract Law. A Contribution to Contractual Rights in Rem': This study examines 'contractual rights in rem', particularly, the landlord's claim against a subtenant pursuant to § 546(2) of the German Civil Code (Bürgerliches Gesetzbuch, BGB). It argues that claims such as § 546(2) of the German Civil Code overcome the dichotomy of rights ¿in rem¿ and ¿in personam¿ and that they should be understood as intermediate rights or, more specifically, partially absolute rights since they do not have the prototypical protection of a right ¿in rem¿.
